The Statement of Rights (section 23 of the Act) is a fundamental part of the person centred Act and promotes the older person’s right to an adequate standard of living in the aged care system. It is a reference point for providers and workers to consider when delivering funded aged care services under the Act. Providers delivering funded aged care services must take all reasonable and proportionate steps to act compatibly with these rights.

The Statement of Rights includes the right for
every older person to have:

  • Independence and Autonomy:
    The right to self-determination, empowerment, and freedom of choice in care decisions.
  • Equitable Access:
    The right to fair and unbiased access to quality and safe aged care services, irrespective of background or circumstances.
  • Quality and Safety:
    The right to receive high-quality, safe aged care services that meet individual needs.
  • Privacy and Information:
    The right to privacy and to be informed about care options and decisions affecting one’s well-being.
  • Communication and Feedback:
    The right to person-centred communication and the ability to raise issues or complaints without fear of reprisal.
  • Advocacy and Social Connections:
    The right to have advocates or significant persons involved in care discussions and to maintain social relationships.
